Description

Identification. Due Process of Law, Identification, Hearing. Evidence, Expert opinion, Consciousness of guilt. Practice, Criminal, Instructions to jury, Argument by prosecutor, Comment by prosecutor, Comment by Judge. O'CONNOR, J. The defendant, Stephen R. Walker, was indicted for armed robbery of a Dunkin' Donuts restaurant in downtown Boston. Prior to trial, the defendant, pro se, moved to suppress both in-court and out-of-court identifications of him on the ground that the pretrial identification procedures were unnecessarily suggestive. No evidentiary hearing was held on the admissibility of the identification evidence. The trial Judge denied the motion, and the case went to trial, the defendant appearing pro se. A jury found him guilty of armed robbery, and he was sentenced to a term of from nineteen to twenty years at the Massachusetts Correctional Institution at Cedar Junction.
